GENERAL
The terms and conditions published on the website http://www.produktna-fotografija.si apply to all services provided by the contractor to clients.
The service provider is the company:

hereinafter the performer or author.
The client of the services is any legal or natural person who has confirmed the sent offer by e-mail, based on a written request or a business meeting (hereinafter the client).
By confirming the offer, the customer agrees that he has read the business conditions and fully agrees with them.
Subscriber agrees to be of legal age to enter into this Agreement.
The client undertakes to ensure that all contact and personal data or company data are up-to-date and correct.
The subscriber undertakes to regularly monitor the e-mail address he specified when ordering the services.
During the period of active participation, the client undertakes to inform the contractor of changes to the e-mail address that he regularly uses. The contractor is not responsible if the messages arrive in the spam folder on the client's side.

THE OFFER
The offer is made based on the demand for the contractor's services. The offer specifies the scope of work, a detailed description of the services, possible stages of photography or production, number of corrections, price and other details. The offer is sent by e-mail and is valid until the specified date or until cancelation. All additional services, additional stages or subsequent corrections are billed additionally.
PRICES AND PAYMENT TERMS
All listed prices are in EUR and do not include VAT, unless otherwise stated next to the price.
Before starting the work, the contractor issues a preliminary invoice to the client. According to the issued estimate, the service requires payment of 50% of the amount on the estimate for the start of work, unless otherwise agreed. The contractor starts work when he receives a transfer to his business account in the amount of 50% of the amount specified in the confirmed offer or after the confirmation of successful transfer has been sent. The remaining amount (50% of the amount) is paid after the service has been completed (i.e. after confirmation of the last design) with an issued invoice. Payment information will be sent to the subscriber's contact email address. The invoice will be based on the data entered by the client in the provided form after confirming the offer and will be sent to the client's contact email address.
The customer undertakes to settle his obligations within the deadline indicated on the proforma invoice and upon correct reference.
The client undertakes to settle all obligations after confirmation of the final design, i.e. to transfer the remaining fee to the contractor's business account.
The client becomes the material owner of the contractor's work and acquires the right to publicize the completed work after payment of all obligations to the contractor.
If the client does not accept and confirm the proposed photographic solutions, the contractor waives the remainder of the fee. Cooperation is hereby terminated. The subscriber has no right to dispose of the received photos.
In the event that the client has provided the contractor with incorrect or misleading information, or has not fully settled the obligations to the contractor within the agreed deadline, or has otherwise violated the terms of business, the contractor reserves the right to limit or interrupt the photography process.
TERMS OF BUSINESS
The contractor reserves the right to change the prices and features of the design packages. Orders placed prior to the change date will be subject to the old prices and features.
WORKFLOW
The contractor starts work after payment of the agreed amount on the preliminary invoice and when the client delivers the agreed content and/or data necessary for the implementation of the project.
The execution deadline is agreed when the contractor receives from the client all the precisely defined requirements and products that he wants the contractor to use in the photo shoot. The agreed deadline may be changed in the event of force majeure, such as a natural disaster, hardware failure, power outage for a longer period of time, or longer interruptions in the internet.
The contractor produces, depending on the nature of the order, the agreed number of photographs. The number of photos is already agreed upon when ordering. Since the contractor also uses his creative abilities for rejected photos, he is entitled to payment of royalties even for rejected drafts, but only up to 50% of the value of the basic fee according to the items of the valid price list.
The contractor does his best to take into account the client's opinion and wishes.
RESPONSIBILITIES AND DUTIES
The contractor undertakes to perform all ordered services with high quality and within the agreed time. When taking photos, he will take into account all the requirements and information he will receive from the client.
The client is obliged to provide the contractor with all the information the contractor needs for its work.
The contractor is responsible for performing his work properly and efficiently. The contractor is not responsible for the quality of the final product.
The client undertakes to settle all obligations after the production of the final photographs, i.e. to transfer the remainder of the fee to the contractor's business account.
The contractor undertakes to hand over or send by e-mail the final photos in all agreed formats to the client within 24 hours after the payment has been made.
The customer undertakes to ensure that the contact information is up-to-date and to regularly monitor the electronic mailbox that he specified when ordering the design.
COPYRIGHT
No one may use an author's work in the field of applied art without the permission of the author or copyright holder.
Author's material rights are alienable, but the author's moral rights are inalienable and every subscriber must respect them according to the provisions of the Act on Copyright and Related Rights.
The work can be modified only by the author himself, and by a third party only with the author's consent.
If the client communicates his ideas and initiatives to the creator, he cannot claim copyright for a specific work.
Drafts remain the property of the contractor; rejected ones can be used without restrictions, and accepted ones within the scope of inalienable copyrights.
Moral copyright allows the creator to call himself the author of the created work and to sign the work.
The author may request 5 copyright copies of his work from the client.
The author has the right to exhibit and reproduce his work for his own promotion and presentation.
CALCULATION OF COSTS
The contractor will bill his service in accordance with the valid price list or the agreed offer. Normally, the cost of mileage is added to the value of the order in the case of field work. We are not responsible for any errors. Before confirming the order, request an exact offer or cost calculation. All service activities (design, graphic preparation or finishing) are charged according to the time spent, according to the applicable hourly rate in half-hourly intervals.
SATISFACTION GUARANTEE OR MONEY BACK
The company Produktna Fotografija, Miha Šubic s.p. is committed to providing high quality product photography services. If the customer is not satisfied with the final materials, he has the right to enforce the satisfaction guarantee in accordance with these general conditions. The customer must notify the company of dissatisfaction in writing no later than 7 days after receiving the final materials. The notice must contain a precise description of the reasons for dissatisfaction and possible suggestions for improvements. The company reserves the right to verify the customer's statements and, if necessary, request additional information.
If it is determined that the final materials do not meet the customer's expectations, the company will refund the entire purchase price.
The satisfaction guarantee does not apply in cases where the dissatisfaction arises from changes requested by the customer after approval of the final materials. The guarantee of satisfaction of the practices does not apply in cases where a free test photo shoot was previously carried out and the customer approved the produced materials.
The company reserves the right to refuse to enforce the satisfaction guarantee in cases of obvious abuse or unjustified enforcement of the guarantee.
The company assumes no responsibility for any direct or indirect consequences of customer dissatisfaction, except to the extent specified in this satisfaction guarantee.
The satisfaction guarantee is an expression of our efforts to provide the highest quality product photography service.
RETURN OF PRODUCTS AFTER THE FINISHED PROJECT
The company Produktna Fotografija, Miha Šubic s.p., undertakes to return all products that are part of the photo shoot. All products that have not been opened, used or otherwise altered from their original condition for the purpose of photography are included. We ask all customers to pick up their products after the photo shoot or to inform us about this within 7 days of the end of the photo shoot at the latest. We keep all products in our studio for a maximum of 30 days after the photo shoot. If the client does not collect the products within 30 days, the company is not obliged to continue storing the products, as it has limited storage capabilities for this.
CHANGES TO THE TERMS OF BUSINESS
The contractor is free to change the terms of business or the offer of services. Any such change becomes effective on the 8th day after it is published on the provider's website.
The customer agrees to periodically visit the website of the contractor and thus be aware of any changes.
CONFLICT SOLVING
All disputes arising from this contract will be resolved by agreement between the contracting parties, if no agreement is reached, the disputes will be resolved by the competent court in Ljubljana.
DISCLAIMER*
The contractor is not responsible for possible occasional problems with the operation of the website, possible inaccuracy of information, nor for possible damage caused by the use of inaccurate or incomplete information. The provider reserves the right to withdraw from the contract or realization of the order if there is a significant error in the offer. A fundamental error includes elements on the basis of which the provider would not have agreed to conclude the contract. The mentioned errors also include obvious errors in the price, which may be the result of technical and other problems.

GENERAL*
The contractor may change the content of the general conditions at any time in accordance with his decision and changes in business.
The contractor will notify users of changes to the general conditions in the usual reliable way - by posting them on the website. It is considered that the user agrees to the changes to the general conditions if he continues to use the website after the changes have been published.
